Welcome to Age of Aeternus ("we," "our," "us," or the "Company"). These Terms of Service ("Terms") govern your access to and use of the Age of Aeternus mobile application, website, and related services (collectively, the "Service").

Service License (All User Content): A worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display your User Content (and your name/username/profile information associated with it) as necessary to operate, provide, maintain, improve, and promote the Service.

This license does not grant us ownership of your content. It generally ends when you delete the applicable User Content, except to the extent (a) we must retain it for backups, security, or legal compliance, (b) it has been shared with others who have retained access, or (c) it is Published User Content (see below).

Published User Content (Public Homebrew Browser): If you make User Content public or publish it through any public-facing content browser or similar feature in the Service ("Published User Content"), you grant us a perpetual, irrevocable, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, create derivative works from, distribute, publicly perform, publicly display, and otherwise exploit that Published User Content for any purpose related to the Service, including:

Moral Rights: To the extent permitted by law, you waive any moral rights (such as rights of attribution or integrity) you may have in User Content, and you agree not to assert them against us or our users.

You do not acquire ownership of Virtual Items. Your license is:

We reserve the right to modify, suspend, discontinue, or remove any Virtual Items at any time, with or without notice. Virtual Items have no monetary value and cannot be redeemed for cash or cash equivalents.

Upon account termination (whether by you or by us), all Virtual Items associated with your account are forfeited without refund, credit, or compensation, except as required by applicable law.

For California Residents: This disclosure is provided pursuant to California Civil Code Section 1723. The "purchase" or "acquisition" of Virtual Items grants only a license as described above, not ownership. When we use terms like "buy," "purchase," "sell," or similar language regarding Virtual Items, we are referring to the acquisition of this limited license, not the transfer of any ownership interest.

15.1 Informal Resolution First

Before filing any formal claim, you agree to contact us at support@nerdhonest.com and attempt to resolve the dispute informally. You must provide a written description of the dispute and allow at least 30 days for informal resolution before pursuing other remedies.

15.2 Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. For users outside the United States, you agree that the laws of Delaware will govern these Terms, except where local law requires otherwise.

15.3 Jurisdiction

Any dispute not resolved informally shall be resolved in the state or federal courts located in Delaware, USA, and you consent to personal jurisdiction in such courts.

15.4 Class Action Waiver

For United States Users: YOU AGREE TO RESOLVE DISPUTES ONLY ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE ACTIONS.

For European Union Users: This class action waiver does not apply to you. You retain all rights under applicable EU consumer protection laws, including the right to participate in collective actions.

We are not liable for failures due to circumstances beyond our reasonable control, including but not limited to: natural disasters (earthquakes, floods, hurricanes), pandemics or epidemics, acts of war or terrorism, civil unrest, government actions or orders, labor disputes or strikes, utility or telecommunications failures, cyberattacks or security incidents affecting our infrastructure, and failures of third-party service providers (such as cloud hosting, payment processors, or app stores).
